1. Introduction

Welcome to www.delken.com.hk (the “Website”). These Terms and Conditions (“Terms”) govern your access to and use of the Website and all services provided by Delken Group Limited (“Delken”, “we”, “us” or “our”).

By accessing or using our Website, or by engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. About Us

Delken Group Limited is a Hong Kong-based company established in 1997. We specialise in professional Recruitment, Staff Secondment (Outsourced Staffing), Payroll Outsourcing, and related HR solutions.

3. Our Services

We provide the following services:

Permanent and temporary recruitment
Staff secondment and contracting
Payroll administration and MPF compliance services
HR consulting and talent management solutions

All services are subject to a separate Service Agreement or Proposal signed between Delken and the Client.

4. Client Responsibilities

Clients agree to:

Provide accurate and complete information for job requisitions and candidate requirements
Comply with all applicable employment and anti-discrimination laws in Hong Kong
Treat all candidates introduced by Delken with professionalism and respect
Not engage any candidate introduced by Delken for a period of 12 months without our prior written consent or payment of the applicable introduction fee

5. Fees and Payment

All fees and charges are quoted in Hong Kong Dollars.
Payment terms are as stated in the Service Agreement or invoice.
For permanent placements, our standard replacement guarantee and refund policy will be specified in the relevant Proposal.

6. Candidate Introduction anmd Placement

Candidates introduced by Delken remain our property until an employment contract is signed.
Clients must notify Delken immediately upon engaging any introduced candidate.
Any breach of introduction terms may result in additional fees or legal action.

7. Confidentiality

Both parties agree to keep all confidential information (including candidate CVs, business strategies, and commercial terms) strictly confidential and not disclose it to any third party without prior written consent.

8. Data Protection and Privacy

Your privacy is important to us. All personal data collected is processed in accordance with our Privacy Policy and the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong. Please refer to our Privacy Policy available at: https://www.delken.com.hk/privacy-policy/ for details on how we collect, use, and protect personal data, and how you can exercise your data subject rights.

9. Intellectual Property

All content on this Website, including text, graphics, logos, and service marks, is the property of Delken Group Limited and protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Delken shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with our services.

Our total liability shall not exceed the total fees paid by the Client in the preceding 12 months for the specific service giving rise to the claim.

11. Termination

Either party may terminate the services in accordance with the terms set out in the Service Agreement. We reserve the right to suspend or terminate access to our services for any breach of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You agree to submit to the exclusive jurisdiction of the Hong Kong courts.

13. Amendments

We may update these Terms from time to time. The updated Terms will be posted on this Website with a revised effective date. Continued use of our services after such changes constitutes your acceptance of the new Terms.
